Hearing in administrative fine proceedings against you as the person concerned
Dear Ms Petrova,
in accordance with § 55 of the Administrative Offences Act (OWiG) you are hereby given the opportunity to respond to the following allegation.
You are charged with having parked the motor vehicle registered in your name, registration number MS-AB 123, on 12 April 2026 at 14:32 in Musterstadt, Bahnhofstraße 14, in an officially marked fire-brigade access route, as a result of which a fire-brigade emergency vehicle was obstructed (§§ 12(1) no. 5 and 49 of the Road Traffic Regulations, § 24 of the Road Traffic Act). Evidence: findings and photographs of an officer of the Public Order Office, the fire brigade's incident report. The photographs may be inspected at the Fines Department during office hours by prior appointment; your defence counsel will be granted access to the file on request.
For this administrative offence the catalogue of fines provides for a fine of 100 euros plus the fees and expenses of the proceedings; in addition, once the decision becomes final, one point will be entered in the driver fitness register.
You are free to comment on the matter or to make no statement on the matter. You are, however, obliged to provide information about your person (Part A of the hearing form). You may engage defence counsel at any time. Should you not have been driving the vehicle yourself at the time of the offence, you are requested to state in Part B the name and address of the person responsible. If you are engaged, married or related to this person, you are not obliged to do so.
Please return the completed hearing form within one week of receipt of this letter. A response is voluntary; notwithstanding this, a penalty notice may be issued after the deadline has expired even without a response from you. Subject to your statements, the proceedings will then continue on the basis of the file. If the person who was driving the vehicle cannot be identified before the limitation period for prosecution expires, the costs of the proceedings will be imposed on you as the registered keeper (§ 25a Road Traffic Act).
This letter is not a formal decision. Please do not transfer any amount at this stage. You may lodge an objection against any penalty notice within two weeks of its service; the corresponding information on legal remedies will be enclosed with the notice.
Relevant documents, in particular any exemption permit, are to be enclosed with your response as copies. Please quote the file reference given above in all enquiries. Your personal data will be processed solely for the purpose of these proceedings; for details please refer to the enclosure.
Yours sincerely,
On behalf of the authority
K. Weber
